Sem tam kupujem domény so zahraničným trademarkom, ak si myslím, že ten produkt sa bude predávať aj na Slovensku či v Česku. Doménu by som držal kým študujem a neskôr tam spravil affiliate alebo rovno predával produkt. Predpokladám, že sk/cz doména nebude danú firmu zaujímať, kým im neškodí a takto by som si v tichosti žil. Predpokladal som aj, že prinajhoršom by som tú doménu predal za pár tisíc usd, teda takú sumu, aby boli spokojné obe strany a súdiť sa im neoplatilo. Amazon však na to išiel trochu prefíkanejšie.
Bol som vlastníkom domén kindlefire.cz, paperwhite.cz a paperwhite.sk. Išlo teda o čítačky elektronických kníh. Paperwhite.cz a paperwhite.sk boli pomerne nové, preto som na nich žiadne stránky. Kindlefire.cz som už mal takmer rovnako dlho ako icitacky.sk a tak som tam mal postavený blog a asi 150 unikátnych článkov. Všetko bolo bez problémov, až mi 30.12.2012 mi prišiel mail od Amazonu:
Dear Associate,
We have an issue that needs to be addressed immediately.
We noticed that you’re using the domain name KINDLEFIRE.CZ. The Associates Program Operating Agreement prohibits your use of Amazon trademarks, or misspellings or variations of Amazon trademarks, in domain names. Please note that our trademark policy also covers any username, group name, or other identifier on any social network website.
We need you to find a new domain name that does not violate the Associates Program Operating Agreement and transfer your content to your new site within the next seven (7) days. We also need you to transfer this domain to Amazon, as well as any other domains you own that contain any of our trademarks.
Please reply to us with your transfer authorization by using the Contact Us form available here contact.
After we hear from you, Amazon will arrange to purchase your KINDLEFIRE.CZ domain for the initial registration price, provided that you agree not to register any other domains containing Amazon trademarks, or misspellings or variations of those trademarks.
If we do not hear from you within seven (7) days, we will be forced to close your associates account and withhold payment of all advertising fees in accordance with the Associates Program Operating Agreement.
While we sincerely appreciate your enthusiasm for our brands, we have a legal responsibility to monitor how others use Amazon trademarks. We obviously want to avoid confusion among customers who see your domain name and wrongly assume that your website and its content are sponsored or written by Amazon.

Keby som nebol ich affiliate partnerom, tak by ma to asi potešilo a asi by som sa aj snažil vyjednávať cenu. Lenže ja som bol a ak by som im tu doménu nedal, zrušili by partnerstvo. A doživotný ban používania partnerského programu jedného z najväčších eshopov sveta by ma mrzelo oveľa viac, ako prísť o jednorazový príjem. Preto som bez kecania hneď napísal, že im domény ( prihodil som rovno aj paperwhite.sk/cz ) prevediem. Doménu kindlefire.cz som presmeroval na ictecky.com a dúfal, že mesiac bude googlu stačiť, aby si uvedomil permanent redirect.
Po prevode som ešte pripomenul, že mi sľúbili nejaké drobné, ak prevediem tie domény. (možno, že to bolo kvôli sk nic, kde treba posielať obálku s podpisom overeným notárom)

Vybral som si credit na associates account. Neskôr sa to objavilo v mojom affiliate vypise.
Aké chyby som urobil?
Ako prvá a hlavná bola, že si nemením ani neskrývam whois data. Čoraz častejšie sa polemizuje, že je to dôležitejšie ako rôzne ip adresy na weby. Keby tam je kontaktná adresa niekoho iného, možno by namiesto pohrozenia zrušenia affiliate partnerstva prišla sťažnosť porušenia trademarku s prípadnou sumou na predaj.
Vedel som, že z kindlefire.cz nemôžem promotovať amazon produkty, takže som to všetko odkazoval na icitacky.sk, odkiaľ som už promotovať amazon mohol. Ale asi si to aj tak všimli z nejakého referrala alebo niečo podobné.
